5. Subscriptions and Payments

Certain features of our Services require a paid subscription. By subscribing, you agree to pay the fees specified at the time of purchase through our third-party payment processor, Paddle. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to change subscription fees with prior notice. Failure to pay may result in suspension or termination of your access to paid features.

6. Intellectual Property

All content, software, designs, and trademarks associated with our Services are owned by or licensed to POD Product Assistant and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the designs and content you upload to our platform, but by uploading, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing our Services.

7. Third-Party Integrations

Our Services integrate with third-party platforms such as Printify, Etsy, Supabase, and Paddle. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of such integrations is subject to the respective third-party terms and privacy policies.

8. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or free from viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, POD Product Assistant, its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of our Services. Our total liability for any claim shall not exceed the amount you paid us for the Services in the preceding 12 months.

Upon termination, your account and right to use the Services will cease immediately, and we may delete any data associated with your account, subject to applicable law.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law principles. Any disputes arising under or related to these Terms shall be resolved through binding arbitration in Illinois, USA, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of material changes by posting the updated Terms on our website or via email. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
